Welcome to NEON SUN. The terms "we", "us" and "our" refer to NEON SUN, a brand of Sounding Labs (ABN 38 813 430 864). NEON SUN operates this store and website, including all related information, content, features, tools, products and services, to provide you, the customer, with a shopping experience (the "Services"). NEON SUN is powered by Shopify, which enables us to provide the Services to you.

These terms and conditions, together with any policies referenced here (the "Terms"), describe your rights and responsibilities when you use the Services. Please read them carefully; they include important information about your legal rights, including warranty disclaimers and limitations of liability. By visiting, interacting with or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.

SECTION 1 — ACCESS AND ACCOUNT

By agreeing to these Terms you represent that you are at least the age of majority where you live. To use the Services you may be asked for information such as your email, billing, payment and shipping details. You represent that all information you provide is correct, current and complete. You are responsible for keeping your account credentials secure and for all activity on your account.

SECTION 2 — OUR PRODUCTS

Every NEON SUN product is made to order. We make every effort to display products accurately, but colours and appearance may differ from what you see on screen depending on your device. Product descriptions and availability may change at any time without notice, and we may limit quantities or discontinue products at our discretion.

SECTION 3 — ORDERS

When you place an order you are making an offer to purchase. NEON SUN may accept or decline any order at its discretion; your order is not accepted until we confirm it, and we must receive payment before acceptance. Because products are made to order, cancellation requests can only be accommodated within 2 hours of placement. If we decline, change or cancel an order we will try to notify you using the contact details you provided. Purchases are subject to return or exchange solely under our Refund Policy. You represent that your purchases are for personal or household use and not for resale.

SECTION 4 — PRICES AND BILLING

Prices, discounts and promotions may change without notice. The price charged is the price in effect when your order is placed, as shown in your order confirmation. Unless stated otherwise, prices exclude taxes, shipping, handling, customs and import charges, which are shown at checkout. You agree to provide current, complete and accurate purchase and payment information, and you represent that you are authorised to use the payment method provided.

SECTION 5 — SHIPPING AND DELIVERY

Delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by carriers, customs or events outside our control. Title and risk of loss pass to you when we hand products to the carrier. See our Shipping Policy for details.

The Services, including all trademarks, brands, text, images, graphics, designs, video, audio and their selection and arrangement, are owned by NEON SUN, its affiliates or licensors and are protected by copyright, trade mark and other intellectual property laws. The NEON SUN name, wordmark, sun device, product names and slogans are trademarks of NEON SUN and may not be used without permission.

We may provide access to third-party tools and links to third-party websites which we neither monitor nor control. These are provided "as is" without warranty of any kind. Your use of them is at your own risk and subject to the third party's own terms. We are not liable for any harm arising from third-party tools, sites, products or services.

SECTION 8 — RELATIONSHIP WITH SHOPIFY

NEON SUN is powered by Shopify, which enables us to provide the Services to you. Any sales and purchases you make in our store are made directly with NEON SUN. By using the Services you acknowledge that Shopify is not responsible for any aspect of any sale between you and NEON SUN, including any injury, damage or loss resulting from purchased products, and you release Shopify and its affiliates from all claims, damages and liabilities arising from your purchases and transactions with NEON SUN.

SECTION 9 — PRIVACY

Personal information collected through the Services is subject to our Privacy Policy, and certain information may also be subject to Shopify's Privacy Policy. Because the Services are hosted by Shopify, Shopify collects and processes information about your use of the Services to provide and improve them, and information you submit may be transmitted to Shopify and to third parties in countries other than where you live.

Information on the Services is provided for general purposes and we do not warrant its accuracy or completeness. EXCEPT AS EXPRESSLY STATED BY NEON SUN, THE SERVICES AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY REPRESENTATION, WARRANTY OR CONDITION OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE. Some jurisdictions do not allow the exclusion of implied warranties, so this disclaimer may not apply to you in full.

SECTION 16 — LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, NEON SUN, ITS DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS AND LICENSORS, AND SHOPIFY AND ITS AFFILIATES, SHALL NOT BE LIABLE FOR ANY INJURY, LOSS, CLAIM OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA OR REPLACEMENT COSTS, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCT, EVEN IF ADVISED OF THE POSSIBILITY. These Terms are governed by the laws of New South Wales, Australia, and you and NEON SUN consent to the jurisdiction of its courts, without prejudice to any mandatory consumer protections that apply where you live.

We may update, change or replace any part of them by posting updates here; we will notify you of material changes as required by law. Your continued use of the Services after changes are posted constitutes acceptance of those changes.
